Minutes, August 26-27, 1992 15 <br /> Mr. Dean Massey, an attorney representing the operator, discussed some <br /> of the work completed at the site and reclamation work remaining, as <br /> well as other requirements of the Settlement Agreement. Mr. Massey <br /> discussed a proposal the operator forwarded to the Division which would <br /> reduce the Division' s retained bond amount from $50,000 to $25,000. <br /> Staff said the Division is only obligated to retain the amount of bond <br /> necessary to maintain the site over the liability period. Staff said <br /> the Division agreed with the modification proposal submitted -by the <br /> operator. <br /> It was noted that no action was required by the Board at this time, <br /> regarding this matter. Consideration of Order to Show <br /> Cause why permit should not be modified or revoked (continued from the <br /> July 1992 Board Meeting) . <br /> Staff presented EXHIBIT A, a copy of the Settlement Agreement adopted <br /> in May of 1991 . The Board was reminded that on July 17, 1990, the <br /> Division issued an Order to the operator to Show Cause why the permit <br /> should not be suspended or revoked, due to a finding of a pattern of <br /> violations; , five other violations were subsequently.. issued to the <br /> operator. <br /> Staff said the operator ceased operation of the mine in January of <br /> 1991 , and during the spring of 1991 the Division became concerned that <br /> the performance bond for the site was inadequate. <br /> Staff said the Agreement set a deadline of January 1 , 1992 to locate a <br /> new permittee for the site. However, the operator was given an <br /> extension of the deadline, in order to pursue negotiations for the sale <br /> of the mine. In July of 1992 the Division learned that the <br /> negotiations ceased , as the potential buyer withdrew their interest in <br /> buying and permitting the mine and performing reclamation. <br />
