Pollutant Concentration <br /> Total Suspended Solids 30,000 milligrams per liter <br /> ("mg/1") <br /> Total Iron 200 mg/1 <br /> Settleable Solids 850 milliliters per liter <br /> 5. The point where the yard area runoff entered the creek is not an <br /> authorized discharge point under the permit. <br /> 6. Coal Creek is state waters as defined by 25-8-103(19) , C.R.S. <br /> (1982). <br /> NOTICE OF VIOLATION <br /> You are hereby notified that the facts stated above constitute a <br /> violation of Part II.A.6 of the permit which states, "Any discharges to the <br /> waters of the state from a point source other than specifically authorized is <br /> prohibited." <br /> CEASE AND DESIST ORDER <br /> Based upon the foregoing findings of fact and notice of violation, and <br /> pursuant to the provisions of 25-8-605, C.R.S. (1982), I hereby order you to: <br /> 1. immediately cease and desist all discharges of wastewater into <br /> state waters which are in violation of the permit; <br /> 2. submit to the division, in writing, within 15 days after issuance <br /> of this order, a detailed statement of the measures you have taken or plan to <br /> take to achieve compliance with paragraph 1 of this order; <br /> 3. submit to the division, in writing, within 10 days of issuance of <br /> this order a statement of your intent to comply herewith. <br /> Pursuant to 25-8-603, C.R.S. (1982), you are required to submit to the <br /> division an answer to the notice of violation. Section 603 also provides that <br /> if the division does not require a hearing, an alleged violator may request the <br /> division to conduct such a hearing. Such request shall be in writing and shall <br /> be filed with the division no later than 30 days after issuance of this order. <br /> The filing of an answer to the notice of violation does not constitute a <br /> request for a hearing. Absent such a request, the division may resolve without <br /> a hearing any issues related to the validity of the notice and order. For <br /> clarification of the rights of the recipients of notices of violation and cease <br /> and desist orders, parties are advised tj consult the Colorado Water Quality <br /> Control Act, 25-8-101 et seq. , C.R.S. (1982). <br /> -2- <br />
