1 THIRD AMENDMENT TO MORTGAGE DEED TO SECURE RECLAMATION BOND File No. C-017-81 THIS INDENTURE made this `1 day of-May, 1983 between MID-CONTINENT RESOURCES, INC . , Box 158 , Carbondale, Colorado 81623 , of the County of Garfield and State of Colorado of the first part and UNITED STATES OF AMERICA and MINED LAND RECLAMA- TION BOARD, Department of Natural Resources , State of Colorado, 723 Centennial Building, 1313 Sherman Street, Denver, Colorado I 80203 of the second part, W I T N E S S E T H: WHEREAS, first party has entered and filed with second party a certain Reclamation Bond in the sum of SEVEN HUNDRED SIXTY-FIVE THOUSAND DOLLARS, which was thereafter increased by First and Second Amendments to ONE MILLION NINE HUNDRED SEVENTY THOUSAND ONE HUNDRED FORTY-EIGHT DOLLARS, and by Third Amendment of this date is increased to ONE MILLION NINE HUNDRED EIGHTY-ONE THOUSAND THREE HUNDRED NINETY-EIGHT DOLLARS ($1, 981, 398) , and this Third Amendment to Mortgage Deed is intended to increase the security for such Bond, THEREFORE to conform to the provisions of the said Reclamation Bond and the First, Second and Third Amendments to Reclamation Bond, the Mortgage to Secure Reclamation Bond is hereby increased to ONE MILLION NINE HUNDRED EIGHTY-ONE THOUSAND I THREE HUNDRED NINETY-EIGHT DOLLARS ($1 , 981 , 398) and the Reclama- tion Bond, as Amended, together with the mortgage securing the same, is hereby ratified and confirmed in all respects. The Mortgage to Secure Reclamation Bond hereby increased is identified as a certain Mortgage Deed from Mid- Continent Resources , Inc. , d/b/a/ MID-CONTINENT COAL AND COKE COMPANY securing Mined Land Reclamation Board, Department of Natural Resources, State of Colorado as stated therein, which document was recorded February 21 , 1980 as Document No. 301803 in Book 544 , Page 32 , Garfield County Clerk and Recorder ' s Office and the security described therein is hereby mortgaged i I , 1
