(IV) Unsatisfied claims against any bond; <br /> A certificate of deposit in the amount of $50,000, due <br /> July 10, 1985, as surety for reclamation of the rock <br /> tunnel project at tre Coal Basin operations, in <br /> accordance with requirements of the Colorado Mined <br /> Land Reclamation Board. <br /> (D) Brief chronological history of business operations <br /> conducted within the last 10 years including information <br /> showing: <br /> (I) Continuous operations; and <br /> (II) The jurisdiction within which each such operation <br /> has been conducted; <br /> Mid-Continent has operated, since 1956, in Coal Basin, <br /> situated in the western portion of Pitkin County, Colorado. <br /> Operations have been continuous in meeting contractual <br /> commitments to U. S. Steel's operations at Provo, Utah, <br /> and Kaiser Steel's operations at Fontana, California. <br /> Operations have been carried out in accordance with <br /> requirements of Pitkin County, and laws of the State <br /> of Colorado and the United States. <br /> (E) An audited financial statement, approved and certified <br /> as accurate by an independent Certified Public Accountant <br /> (CPA) , where such CPA is satisfactory to the Division as <br /> disinterested and competent to evaluate the applicant's <br /> financial capability; <br /> See Attachment E. <br /> (F) A determination by such independent CPA that, based <br /> upon the audited financial statement, as well as any other <br /> information deemed useful by the CPA, the applicant will be <br /> financially capable to meet all obligations and costs under <br /> the proposed reclamation plan for the life of the mine, as <br /> long as: <br /> See Attachment E. <br /> (G) A statement listing any liens filed on the assets <br /> of the applicant in any jurisdiction in the United States, <br /> actions pending or judgments rendered within ten years <br /> against the applicant but not satisfied, and petitions or <br /> actions in bankruptcy including actions for reorganization. <br /> Each such lien, action, petition, or judgment shall be <br /> identified by the named parties, the jurisdiction in which <br /> the matter was filed, the case, file or docket number, the <br /> date of filing and final disposition or current status of <br /> any action still pending; and <br /> None. <br />
