ADDENDUM TO DEED OF TRUST
THIS ADDENDUM made this � day of August, 1988
between MID-CONTINENT RESOURCES, INC. (MCR) and THE STATE OF
COLORADO (THE STATE) ,
WITNESSETH:
WHEREAS , MCR has executed and delivered Coal
Reclamation Bond to the State of Colorado and the United
States/Office of Surface Mining Reclamation and Enforcement
( OSMRE ) for the principal sum of THREE MILLION DOLLARS
( $3, 000, 000 ) ,
WHEREAS, MCR has executed and delivered to THE STATE
that certain Deed of Trust for THREE MILLION TWO HUNDRED SEVENTY-
TWO THOUSAND FIVE HUNDRED DOLLARS ( $3, 272, 500) in favor of the
Public Trustee of Garfield County, Colorado conveying certain
lands therein described to be held in trust for the benefit of
THE STATE and the United States of America, as surety, for the
faithful performance by MCR of it ' s obligations to THE STATE and
the United States (OSMRE) evidenced by said Bond,
WHEREAS the parties desire by this Addendum to ratify,
confirm and approve the said Bond and Deed of Trust as surety
therefor,
THEREFORE IN CONSIDERATION OF THE PREMISES IT IS
AGREED:
1. The said Deed of Trust dated December 11, 1984
recorded on the same date, bearing Reception No. 357928 and
appearing in Book 661, Pages 215-217, Garfield County Clerk and
Recorder' s office is hereby ratified, confirmed and declared to
be surety for the said Coal Reclamation Bond in favor of the
State of Colorado and the United States/Office of Surface Mining
Reclamation Enforcement ( OSMRE) for the sum of THREE MILLION
DOLLARS ( $3, 000, 000 ) .
2. The addresses shown on the said Deed of Trust as
recorded are hereby amended as follows:
