FIRST AMENDMENT TO DEED OF TRUST
TO SECURE RECLAMATION BOND OR BONDS AND FUTURE ADVANCES
THIS INDENTURE made this 7th day of April, 1989 between
MID-CONTINENT RESOURCES, INC. , Box 500, Carbondale, CO 81623, of
the County of Garfield and State of Colorado of the first part
and the -MINED LAND RECLAMATION BOARD OF THE STATE OF COLORADO,
215 Centennial Building, 1313 Sherman Street, Denver, CO 80203-
2273 of the second part,
WITNESSETH:
WHEREAS, first party has executed and delivered Coal
Reclamation Bond to the State of Colorado and the United
States/Office of Surface Mining Reclamation and Enforcement
( OSMRE ) for the principal sum of THREE MILLION DOLLARS
( s3, 000, 000. 00 ) ,
WHEREAS, first party executed Deed of Trust on December
11, 1984, recorded on the same date, bearing Reception No. 357928
and appearing in Book 661, Pages 215-217, Garfield County Clerk &
Recorder ' s Office wherein first party was Grantor and the State
of Colorado , Mined Land Reclamation Board was named as
beneficiary,
WHEREAS , it has been agreed that the United
States/Office of Surface Mining Reclamation and Enforcement is
also a beneficiary of said Bond and Deed of Trust and the same
-must be payable to both the United States of America and the
State of Colorado;
NOW, THEREFORE the referred to Deed of Trust is hereby
amended to include the United States of America/Office of Surface
Mining and Reclamation and Enforcement, as a joint obligee with
the State of Colorado, Mined Land Reclamation Board.
