BANTA, Director <br /> June 20, 1988 <br /> Ms. Diane Delaney <br /> Mid-Continent Resources, Inc. <br /> 201 Centennial street, Suite 406 <br /> GI enwood Spri ngs, Col orado 81601 <br /> .a <br /> Re: Coal Basin Mines, Permit No. C-81 -017 <br /> Reclamation Bond, Deed of Trust <br /> Dear Ms. Delaney: <br /> Upon receipt of the three appraisals for the "Industrial Park", "Val esquez <br /> Property" and the "Limestone Plant" along with the proposed draft of the <br /> "Fifth Amendment to Reclamation Bond" and "Fifth Amendment to Mortgage Deeds <br /> and First Amendment to Deed of Trust to Secure Reclamation Bond", we find <br /> several issues that we feel need to be clarified prior to acceptance and/or <br /> finalization of your bonding documents. <br /> We need to first clarify whether Mid-Continent will be submitting a Deed of <br /> Trust on one property or three. If Mid-Continent chooses to submit all three <br /> pieces of property indicated in the appraisals, we would reauest for each <br /> property one Deed of Trust, one Title Insurance, one appraisal , and a new <br /> reclamation bond document that list very specifically the legal description <br /> completed on the Division's bonding form, which has already been approved and <br /> accepted by the Attorney Generals Office. To be consistent with the past (two <br /> properties, two Deeds of Trust), we would prefer to have the third property <br /> (the Limestone Plant) on a separate Deed of Trust and Reclamation Bond <br /> document in lieu of adding a fifth amendment to an already weighty bond file <br /> for the Industrial Park property. Thereby making it easier to process a bond <br /> reduction or release, if neccessa ry, and prPventi ng this file from getting <br /> further muddled with additional amendments. <br /> If Mid-Continent chooses to submit one piece of property, we would still <br /> require a Deed of Trust, Title Insurance, an appraisal , and a reclamation bond <br /> document on our approved form that clearly lists the legal description of the <br /> property. <br /> 215 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.(303) 866-3567 <br />
