failing to maintain the roads to prevent erosion and 2) failure to <br /> stabilize road cuts and fills. <br /> The second TDN was issued from AFO to address the non-coal waste <br /> evident in so many areas of the mine. Additionally, the waste rock <br /> pile non-coal waste disposal area was addressed. The non-coal <br /> waste needs to be cleaned up in areas designated by the approved <br /> mine plan and the non-coal waste area needs to be routinely <br /> compacted and covered. <br /> Several times during the inspection the state inspector and I <br /> discussed the need for enforcement actions by either the State or <br /> OSM to address the on the ground situation. At no time did the <br /> State guarentee that it would take prompt appropriate action to <br /> cause the violations to be corrected. Additionally, I contacted <br /> the State prior to writing the second TDN from the office <br /> concerning the non-coal waste. Steve Renner indicated that I <br /> should send the TDN and then the State would address the situation. <br />
