Renner, Coal Program Supervisor j <br /> Mined Land Reclamation Division <br /> Department of Natural Resources <br /> 215 Centennial Building <br /> 1313 Sherman Street <br /> Denver, CO 8 03 <br /> Re: Ten-Day Notic o. 91-02-355-002, Coal Basin Mine, Mid Continent <br /> Resources <br /> Dear Mr. Renner: <br /> The following is a written finding, in accordance with 30 CFR 842.11, <br /> regarding the Mined Land Reclamation Division's (MLRD) response to the <br /> above-referenced Ten-Day Notice (TDN) . <br /> On August 27, 1991, the Albuquerque Field Office (AFO) conducted a State <br /> enforcement follow-up inspection of the Coal Basin Mine. The inspection <br /> resulted in the issuance of the TDN referenced above for alleged <br /> violations of the Colorado rules. While AFO never received a hard copy <br /> response to the TDN, MLRD provided an oral response on September 20, <br /> 1991. <br /> The alleged violations were for: (1) Failure to place and store noncoal <br /> waste in a controlled manner; and (2) failure to routinely compact and <br /> cover noncoal waste. MLRD's response indicated that two Notices of <br /> Violation (NOV) (C91-022, 023) would be issued. The NOV's were issued <br /> on September 23, 1991. <br /> AFO has reviewed the NOV's and finds that they address the concerns <br /> outlined in the TDN. AFO, therefore, finds MLRD's response to TDN <br /> 91-02-355-002, Violations 1 and 2 of 2, to constitute appropriate <br /> action. AFO will continue to monitor the disposition of the State NOV's <br /> to ensure that the basis for AFO's finding is substantiated. <br />
