r
Diane Delaney
Page 2
The Division respects your position that it would not be appro-
priate for GCA to be a party to the settlement agreement . How-
ever, the Division does believe that it would be appropriate for
us to recommend a mechanism to the Board that would provide for
the continued participation of GCA and CVEPA. Accordingly, I
have amended our proposed Order, a copy of which is attached, to
allow the parties to petition the Board for a hearing on compli-
ance with the terms of the agreement.
Finally, Mr . Mechau also asked to be included in the inspection
provided for in §D. 1 of the agreement. Yesterday you indicated
that, although Mid-Continent may allow Mr . Mechau to attend the
inspection, you do not intend to include such a provision in the
agreement. The Division has not taken any position on Mr .
Mechau' s request and, accordingly, is not recommending any
changes to §D. 1.
Please let me know if you concur with the suggested changes to
the agreement and the order . Once I hear from you, I will pre-
pare a final copy of the settlement agreement reflecting all of
the agreed upon changes. Pursuant to the terms of the prehearing
order, we must provide the other parties with our proposed order
and settlement agreement by May 16. Thank you for your continued
cooperation in this matter.
Sincerely,
FOR THE ATTORIEY GENERAL
FRANK R.
