reports, and shall provide the Division with a copy of each quar- <br /> terly report produced during the time for the performance of the <br /> terms of this agreement. <br /> 7 . Mid-Continent shall maintain the site in compliance <br /> with all applicable statutes, regulations and permit conditions. <br /> 8. By April 19 , 1991, Mid-Continent shall provide the <br /> Division with evidence of adequate, current liability insurance <br /> on the mine site and shall complete the required abatement for <br /> NOV Nos. C-90-049, C-90-050, C-90-051 and C-90-52 . <br /> 9 . The $4,000.00 civil penalty assessed for NOV Nos. <br /> C-90-049, C-90-050, C-90-051 and C-90-052 shall be suspended if <br /> the site is permitted and bonded by a qualified purchaser and <br /> Mid-Continent performs all of its obligations under this settle- <br /> ment agreement. The civil penalty shall be due and payable upon <br /> failure to perform any such obligation. <br /> 10 . By June 28, 1991 Mid-Continent shall provide the Divi- <br /> sion with clear and convincing evidence that it has received and <br /> accepted a bona fide offer from a qualified purchaser who stands <br /> ready, willing and able to purchase the Coal Basin Mine, and that <br /> such purchaser fully intends to obtain a permit to continue coal <br /> mining operations at the site. <br /> 11. By September 30 , 1991, Mid-Continent shall provide the <br /> Division with clear and convincing evidence that the Coal Basin <br /> Mine has been sold to a bona fide purchaser who intends to obtain <br /> a permit to continue coal mining operations at the site. <br /> 12. By October 30 , 1991, the purchaser of the Coal Basin <br /> Mine shall submit an application for a permit transfer, or for a <br /> new permit, to conduct coal mining operations at the Coal Basin <br /> mine. It shall be Mid-Continent ' s obligation, under the terms of <br /> this agreement, to assure that such event occurs. <br /> 13 . By January 2, 1992 Mid-Continent ' s successor shall <br /> obtain a valid permit to conduct coal mining operations at the <br /> Coal Basin mine and shall submit a valid performance bond suffi- <br /> cient to assure the completion of the reclamation plan if the <br /> work had to be performed by the State in the event of forfeiture. <br /> It shall be Mid-Continent ' s obligation, under the terms of this <br /> a,17eermeni , to assure that such e ;*-nt o.;cLir s. <br /> 14 . Nothing in this agreement sham be construed to mean <br /> that the provisions of Mid-Continent ' s permit, including the <br /> provision of this settlement agreement setting the performance <br /> -3- <br />
