We hope to be able to <br /> enter into a settlement agreement with Mid--Continent which we will be able to <br /> recommend to the Mined Land Reclamation Board as a resolution to the matter. <br /> The settlement agreement will contain provisions which will allow <br /> Mid-Continent the opportunity to sell the mine to a qualified buyer. Specific <br /> time frames for sale of the mine and transfer of the permit to a qualified <br /> purchaser will be specified. The agreement will also include requirements <br /> relating to performance bond increase, site maintenance, permit compliance and <br /> road and portal bench stabilization. Failure to comply with terms of the <br /> agreement, if approved by the Board, would justify immediate permit <br /> revocation, at which time the Board would either order forfeiture of the <br /> reclamation bond or order final reclamation to commence in compliance with a <br /> set schedule. <br /> We are proceeding with our mid -term permit review, although there is <br /> significant overlap between issues of concern raised in that review and issues <br /> pertinent to the Show Cause Order. For obvious reasons, the Show Cause Order <br /> and related settlement agreement is taking precedence at this time. Concerns <br /> raised by the Coal Basin Group will be given consideration in both the <br /> settlement agreement and the mid-term review. We appreciate the prompt <br /> response in submitting information following the March 8 meeting, and we are <br /> open to any further comments or suggestions any of you might have.
