We intend to store a <br /> considerable portion of this hay at Mine #5, which we are reclaiming this summer. <br /> As the areas which drain to the sediment pond are to be graded and seeded, the <br /> placement of these bales will be outside the established sediment control system. <br /> We anticipate placement of the hay bales on a portion of the old railroad grade right-of- <br /> way, due east of the sediment pond, and just beyond the road. <br /> I do not believe that a Small Area Exemption is necessary as the placement of the <br /> bales will not disturb the ground surface, nor cause any sediment loss.
