-62- <br /> XXIV. Miscellaneous Compliance - Rules 2.05.6(5), 4.029 4.12, 4.19, 4.219 <br /> 4.28 and 4.30 <br /> No problems were identified with respect to the requirements of these <br /> sections. <br /> The proposed operation is in compliance with the requirements of this section. <br /> XXV. Operations on Lands Subject to Limitations or Prohibitions - <br /> Rules 2.03.7 and 2.10 <br /> The Division finds, pursuant to the finding required by 2.07.6(2)(d), that the <br /> permit area of the proposed operation is not within: <br /> a. an area designated unsuitable for mining; <br /> b. an area under study for designation as unsuitable for surface coal <br /> mining; <br /> c. on any lands subject to prohibitions or limitations; <br /> d. within 300 feet of any occupied building; and <br /> e. the load-out facility is within 100 feet of the outside <br /> right-of-way of a public road. However, this facility has been in its <br /> present location since 1956. Therefore, the load-out is subject to <br /> existing valid rights in accordance with Rule 2.07.6(2)(d) . <br /> The proposed operation is in compliance with the requirements of this section. <br /> XXVI . Demonstration that Surface Coal Mining and Reclamation Operations <br /> can be Feasibly Accomplished - Rule 2._O_7._6T2_TT7b <br /> Contingent upon the satisfactory resolution of stipulations presented in this <br /> Findings Document, the following finding of compliance is valid: <br /> The Division finds, pursuant to Rule 2.07.6(2)(b), based on information in the <br /> application and from all available sources, that surface coal mining and <br /> reclamation operations can be feasibly accomplished under the Mining and <br /> Reclamation Plan contained in the application. <br /> The proposed operation is in compliance with the requirements of this section. <br /> XXVII. Compatibility with Anticipated Adjacent Operations - Rule 2.07.6(2)(i ) <br /> The Coal Basin Mines is the only coal mining operation in the vicinity and no <br /> other operations are anticipated. <br /> Therefore, pursuant to Rule 2.07.6(2)(i ) , the Division finds that the proposed <br /> operations will not be inconsistent with other operations anticipated to be <br /> performed in areas adjacent to the proposed permit area. <br />
