-60- <br /> The applicant requested permission to monitor the subsidence monument network <br /> two times each summer. Quarterly monitoring, as required normally by Rule <br /> 2.05.6(6)(c), is precluded in Coal Basin by rugged terrain, deep snowpack and <br /> extremely harsh winter weather conditions. The Division, based upon its <br /> inspection experience within Coal Basin, agrees with the company's request for <br /> variance in this regard. The subsidence monitoring aspects of Mid-Continent <br /> Resources, Inc. application for the Coal Basin Mines are acceptable to the <br /> Division. <br /> During the course of the permit review, it was noted that if subsidence were <br /> to occur, lands outside the permit area could be affected, assuming a <br /> conservative angle of draw of 20.5°. Mid-Continent satisfied this concern by <br /> agreeing to limit the extraction of coal to those areas defined by the <br /> projection of the lease perimeters to the depth of the coal seam being <br /> extracted, along an angle of draw of 20.50 from vertical . <br /> Alternatively, coal may be extracted to within 50 feet from the lease <br /> boundaries provided written consent and approval is obtained and filed with <br /> the Division from surface landowners of the area adjacent to the leases <br /> located within a 20.50 angle of draw from vertical . <br /> The proposed operation is in compliance with the requirements of this section. <br /> XXIII . Special Categories of Mining - Rules 4.27 and 4.28 <br /> The only special categories of mining that apply to the Coal Basin operation <br /> are coal processing plants and support facilities not located at or near the <br /> mine site and operations on steep slopes. <br /> Coal Processing Plants and Support Facilities Not Located at or Near the Mine <br /> Site <br /> Information on the Coal Basin load-out facility which was reviewed by the <br /> Division can be found in Chapter VII and Appendices of Volume 7 of the <br /> application. <br /> Mid-Continent Resources operates a coal load-out facility in Carbondale, <br /> Colorado, 22 miles from the mine site. The proposed permit area is 27 acres. <br /> The existing load-out facility is designed to handle two million tons of coal <br /> per year. The coal load-out facility consists of a railroad spur, access <br /> roads, parking lot, engineering office, scales, covered 28,000 ton slot bin, <br /> conveyors, and train load-out tipple. A complete list of the facilities is in <br /> Table VII-C-1 of Chapter VII, Volume 7. <br />
