-58- <br /> Light use roads at Coal Basin are used for maintenance of ventilation fans, <br /> explorations activities, subsidence monitoring, and access to mine <br /> escapeways. The light use roads are infrequently used and most are not kept <br /> open during the winter months. The locations of these roads are shown on <br /> Exhibit II-B-5 of the application. <br /> The applicant supplied sufficient information on the light use roads to find <br /> the roads in compliance with all design criteria, except grade. No <br /> information was submitted on the grade of the light use roads. Field <br /> inspections indicated at least one light use road (Mine No. 2 escapeway) which <br /> may exceed the overall grade of 10 percent and the maximum pitch grade of 20 <br /> percent. However, as previously discussed with regard to the haul and access <br /> roads, if the roads are not in compliance, the resultant environmental damage <br /> which would occur to bring them into compliance would be detrimental . <br /> Furthermore, many of these light use roads, such as the Mine No. 2 escapeway, <br /> are reseeded following each use if they are infrequently used. Therefore, the <br /> Division finds the light use roads to be environmentally acceptable. <br /> The Division has reviewed the road drainage designs and find the proposed <br /> operation to be in compliance. <br /> Two new access roads are planned to be constructed to the new refuse pile. <br /> One road is to be constructed along the conveyor corridor for access to the <br /> lower portion of the pile. The second road is to be constructed for access to <br /> the upper portion of the pile and for conveyor maintenance. The proposed <br /> designs meet the requirements of Rule 4.03.2, with one exception. The designs <br /> for the road to the top of the pile contain conflicting information on the <br /> slopes of road cuts and road embankments. Therefore, the following <br /> stipulation is necessary. <br /> Stipulation No. 11 <br /> PRIOR TO CONSTRUCTION OF THE ACCESS ROAD IN DISNEY CANYON, THE <br /> PERMITTEE MUST EITHER COMMIT TO CONSTRUCTION OF THE ROAD CUTS AT A <br /> GRADIENT NO STEEPER THAN lh:ly IN ROCK AND 1 .5h:ly IN UNCONSOLIDATED <br /> MATERIAL AND COMMIT TO CONSTRUCTION OF ROAD EMBANKMENT AT GRADIENT NO <br /> STEEPER THAN 1 .5h:ly OR SUBMIT APPROPRIATE GEOTECHNICAL ANALYSES WHICH <br /> SHOW THAT THE PROPOSED ROAD CUTS HAVE A MINIMUM SAFETY FACTOR OF 1 .5 <br /> AND THE ROAD EMBANKMENTS HAVE A MINIMUM SAFETY FACTOR OF 1 .25. IF THE <br /> PERMITTEE COMMITS TO THE STIPULATED CONSTRUCTION GRADIENT ABOVE, THE <br /> CROSS-SECTIONS MUST BE CHANGED ON THE MAP. <br /> With satisfactory resolution of the stipulation, the proposed operation will <br /> be in compliance with the requirements of this section. <br /> XX. Bonding - Rule 2.05.4(2)(b) <br /> Prior to submission of Permit Revision No. 1 , Mid-Continent Resources had <br /> submitted a reclamation bond in the amount of $2,350,623.00. The reclamation <br /> cost estimate for the proposed activities in Permit Revision No. 1 is <br /> $205,252.00 which makes the total bond amount required $2,555,875.00. <br /> Mid-Continent Resources has submitted two deed of trust with a combined value <br /> of $2,663,748.00 which is in excess of the amount required. <br />
