Proposed Decision <br /> The Colorado Office of Mined Land Reclamation proposes to approve , with <br /> stipulations , an application for a revision to a permit to conduct coal mining <br /> submitted by Mid-Continent Resources for the Coal Basin Mines . <br /> This approval decision is based on a finding that the proposed operation will <br /> comply with all requirements of the Colorado Surface Coal Mining Reclamation <br /> Act, C.R.S. 1973, as amended , 34-33-101 et sec . , and the regulations <br /> promulgated pursuant to the Act. <br /> The permit application and the stipulations will become a binding part of the <br /> permit upon approval . The stipulations for the Coal Basin Mines are as <br /> follows : <br /> Stipulation No. 3: <br /> Prior to reactivation of Mine No. 4, the permittee must construct the <br /> sediment ponds , as designed, on the southeast side of the Mine No. 4 <br /> bench. <br /> Stipulation No. 4: <br /> The permittee must conduct a statistically valid revegetation monitoring <br /> program every other year following reclamation of the first section of <br /> the new coal processing waste embankment. Each additional area <br /> revegetated must be included in the monitoring program during the third <br /> and subsequent growing seasons . The south and west aspects lust be <br /> monitored separately from the north and east aspects plus the flat <br /> areas . Monitoring must continue on all areas revegetated until either <br /> bond is released or the Division approves discontinuation of monitoring <br /> in writing. <br /> If revegetation monitoring shows that revegetation success standards are <br /> not being met and are not likely to be met in subsequent years , the <br /> permittee must make whatever changes in the reclamation plan the Division <br /> deems appropriate and implement these changes in the areas where <br /> revegetation success standards are not being met. <br /> Stipulation No. 5: <br /> Mid-Continent Resources , Inc. will submit by August 28, 1992 , plan <br /> drawings and cross-sections of the incised catchment basins proposed for <br /> the controlling of sediment along the road system, along with details of <br /> the outlet/discharge structures , and maps identifying their proposed <br /> locations . <br /> Stipulation No. 6: <br /> Mid-Continent Resources , Inc . will submit by August 28, 1992 , plan <br /> drawings and cross-sections of the check dam structures proposed for <br /> stabilization of erosionally formed gullies exceeding one foot in depth , <br /> along with maps identifying their locations <br />
