HISTORY: Four violations have been issued to Mid-Continent in the
past twelve months. $200 is assessed for history.
SERIOUSNESS: A 500 foot section of the ditch was damaged and
runoff escaping from the ditch caused minor damage within the
permit area. Apparently, all runoff was contained in sediment
ponds so, there was no off-site damage. $500 is assessed for
moderate seriousness.
FAULT: The operator had apparently installed channel protection
in accordance with the approved design. However, adequate measures
to repair damage resulting from recent storms had not been taken.
The operator was negligent in not repairing this damage. $250 is
assessed for negligence.
GOOD FAITH: Good faith is not relevant since the violation has
not been abated. None is awarded.
