Box 1298
Glenwood Springs, CO 81601 ✓AN 3 19^
January 9, 1992
Dan Mathews
Mined Land Reclamation Division
1313 Sherman
Room 215
Denver, CO 80203
RE: NoV Abatement Extension Requests.
Dear Mr. Mathews:
Mid-Continent Resources, permit C-81-017, requests abatement
extensions for completion of on-the-ground remedial actions for an
additional 90-day period, from January 22 , 1992 .
The extension is requested for Notices of Violation C-91-016, C-91-
017 and C-91-022. The Division, by letter dated November 20, 1991,
approved abatement extensions until January 22 , 1992 on the basis
that heavy snowfall had prevented completion of the required work.
All areas in which the necessary abatement work must be done remain
under heavy snowcover, thus preventing completion of the required
on-the-ground remedial actions.
This request is made in accordance with the provisions of Rule 5 of
the regulations. Specifically:
Rule 5.02 .2( 2) (c) of the approved regulations provides that
Circumstances which may qualify a surface coal mining
operation for an abatement period of more than 90 days
are:
(iv) Where climatic conditions preclude abatement within 90
days, or where, due to climatic conditions, abatement
within 90 days clearly would cause more environmental
harm than is would prevent . . .
