JUSTIFICATION OF SETTLEMENT AGREEMENT FOR <br /> NOV C-91-017 <br /> NOV C-91-017 was written for "failure to maintain access / light use road <br /> surfaces and drainage ditches as required to control erosion, minimize damage <br /> to adjacent property and resources, and prevent, to the extent possible , <br /> additional contributions of suspended solids to stream flow." NOV C-91-017 <br /> was issued by Dan Mathews , Reclamation Specialist, on September 18, 1991 . As <br /> Dan stated in the NOV; this notice applies to Roads B, C, D, E, F, and G. The <br /> situation was found to be in noncompliance with regulatory sections 4.03.2(4) , <br /> 4.03.2(4)(a)(iii ) & (iv) , 4.03.2(4)(c) & (d) , 4.03.2(6)(a) & (b) , 4.03.30 )(a) <br /> & (b) , 4.03.3(6)(a) , and Exhibit II-B-App. 7 - At. 2 (Plates 1-B, 2, 3, 4, 5, <br /> 6 & 7) of the permit application. <br /> The penalty assessment proposed by the Division Assessment Officer was: <br /> History $200.00 <br /> Seriousness $1 ,700.00 <br /> Fault $750.00 <br /> TOTAL PROPOSED CIVIL PENALTY: $2,700.00 <br /> Ms. Diane Delaney, representative of Mid-Continent Resources, Inc. , withdrew <br /> the request for a conference regarding NOV CO-91-017.
