As you know the Division sent out a memo in <br /> May, 1991 requiring all operators to modify existing sedimentation <br /> ponds which did not have separate primary and emergency spillways <br /> by September, 1991. Coal Basin Mines submitted a technical revision <br /> to the Division which was not approved until October, 1991. By this <br /> time it was too late in the season for construction to be completed <br /> before snowfall. The Division took this into consideration and <br /> granted Mid-Continent until tle following cons uction season to <br /> complete the modifications. C sl?-e <br /> In meetings held with the Division earlier this year it was <br /> reiterated that construction must be completed this year on the <br /> ponds. Representatives from Coal Basin indicated that they <br /> understood this and would complete the work by fall. On August 20, <br /> 1992 while on inspection at the mine it was clear that no work had <br /> been conducted on any of the ponds requiring modification. Given <br /> the short construction season it seemed likely that work would not <br /> be completed this season. Therefore, I issued the violation with <br /> September 20, 1992 as the abatement date to have the work <br /> completed. <br /> The operator did not submit any comments within fifteen days of <br /> issuance. Therefore, I am submitting this memo along with a civil <br /> penalty worksheet for your penalty assessment. Just for your <br /> information, the operator has received six violations in the past <br /> twelve months starting on August 27, 1991. They are 91-015, -016, - <br /> 017, -018, -022, -023 . <br /> I apologize for the copy quality. If you need legible copies, <br /> please see me.
