NoVs C-90-049, C-90-050. <br /> Dear Mr. Mathews: <br /> Mid-Continent Resources (Permit C-81-017) requests an extension of <br /> time to complete the abatement requirements for NoVs C-90-049 and <br /> C-90-050. Presently, July 18, 1991 is the date fixed for <br /> abatement of these violations. <br /> Section 5.03 .2(2) (c) of the regulations allow the Division to <br /> extend the abatement date of a Notice of Violation for <br /> circumstances which include: <br /> (i) Where the permittee of an ongoing permitted operation has <br /> timely applied for and diligently pursued a permit <br /> renewal or other necessary approval of designs or plans <br /> but such permit or approval has not been or will not be <br /> issued within 90 days after a valid permit expires or is <br /> required for reasons not within the control of the <br /> permittee; <br /> (iv) Where climatic conditions preclude abatement within 90 <br /> days, or where, due to climatic conditions, abatement <br /> within 90 days clearly would cause more environmental <br /> harm than it would prevent. . . <br /> Mid-Continent's request for extension of the period for abatement <br /> is made on the basis that (1) a request for Technical Revision has <br /> been filed and we are awaiting approval of secondary spillway <br /> designs prior to proceeding with work required for abatement of NoV <br /> C-90-049, and that the application was filed as soon as snowpack <br /> conditions allowed for on-site inspection of the ponds which are <br /> the subject of the technical revision request; (2) Climatic <br />
