RE: Request for Extension. NoVs C-90-049, C-90-050.
Dear Mr. Mathews:
Mid-Continent Resources (Permit C-81-017) requests an extension of
time to complete the abatement requirements for NoVs C-90-049 and
C-90-050. Presently, July 18, 1991 is the date fixed for
abatement of these violations.
Section 5.03 .2(2) (c) of the regulations allow the Division to
extend the abatement date of a Notice of Violation for
circumstances which include:
(i) Where the permittee of an ongoing permitted operation has
timely applied for and diligently pursued a permit
renewal or other necessary approval of designs or plans
but such permit or approval has not been or will not be
issued within 90 days after a valid permit expires or is
required for reasons not within the control of the
permittee;
(iv) Where climatic conditions preclude abatement within 90
days, or where, due to climatic conditions, abatement
within 90 days clearly would cause more environmental
harm than it would prevent. . .
Mid-Continent's request for extension of the period for abatement
is made on the basis that (1) a request for Technical Revision has
been filed and we are awaiting approval of secondary spillway
designs prior to proceeding with work required for abatement of NoV
C-90-049, and that the application was filed as soon as snowpack
conditions allowed for on-site inspection of the ponds which are
the subject of the technical revision request; (2) Climatic
