RE: Notice of Violation Abatement Extensions for
NOV's C-90-049 , 051 , 052 and 053 at
Coal Basin Mine (C-81-017 )
Mid-Continent has requested an extension of the abatement periods for the four
NOV's referenced above. The NOV's were issued October 23, 1990. Shortly
after that date, snow began to accumulate at the mine site and it was not
feasible to complete the abatement work . Therefore, the Division extended the
abatement period by 90 days. This 90 day period expires on January 21 , 1991 .
Winter conditions still exist at the mine and I would not anticipate that the
abatement work for the NOV's could be reasonably accomplished before late
April or early May, due to snow cover at the mine. Therefore, I recommend
another 90 day extension of the abatement periods. Rule 5.03.2(e) requires
your concurrence for this extension. The appropriate forms are attached for
your signature as well as a copy of the letter from Mid-Continent requesting
the extension.
