RE: Request for Extension for Abatement of NoVs C-90-049 ,
C-90-050 , C-90-051 , C-90-052 .
Dear Mr. Mathews:
On January 21 , 1991 the Division granted an extension to the time,
until April 19 , 1991 for abatement of Notices of Violation C-90-
049, C-90-050 , C-90-051 and C-90-052 .
These notices of violation were written last fall , just before the
onset of winter. As noted at that time, the mine site is at high
elevation (8 ,0001 to 10 ,0001 ) and we had already entered the frost
and snow season. Completion of the work required by the NoVs under
frost and snow conditions would be difficult if not impossible, and
the disturbance to the ground would be environmentally harmful .
The heavy snowpack which prevented access to the areas in which
the abatement work must be done remains and, at present, snow
conditions still do not permit Mid-Continent to reach the areas.
Accordingly, Mid-Continent requests an additional extension of 90
days, in consideration of the climatic conditions at the mine site,
in which to complete the required work for abatement of the cited
violations.
The regulations, at §5 . 03 . 2(2) (c) (iv) , allow for extension, "Where
climatic conditions preclude abatement . . . [or] would cause more
environmental harm than it would prevent . . .
§5 .03 . 2(2) (g) allows a request for further extension "Where the
condition or circumstance which prevented abatement within 90 days
exists at the expiration of such extension. . . "
