As noted at that time, the mine site is at high <br /> elevation (8 ,0001 to 10 ,0001 ) and we had already entered the frost <br /> and snow season. Completion of the work required by the NoVs under <br /> frost and snow conditions would be difficult if not impossible, and <br /> the disturbance to the ground would be environmentally harmful . <br /> The heavy snowpack which prevented access to the areas in which <br /> the abatement work must be done remains and, at present, snow <br /> conditions still do not permit Mid-Continent to reach the areas. <br /> Accordingly, Mid-Continent requests an additional extension of 90 <br /> days, in consideration of the climatic conditions at the mine site, <br /> in which to complete the required work for abatement of the cited <br /> violations. <br /> The regulations, at §5 . 03 . 2(2) (c) (iv) , allow for extension, "Where <br /> climatic conditions preclude abatement . . . [or] would cause more <br /> environmental harm than it would prevent . . . <br /> §5 .03 . 2(2) (g) allows a request for further extension "Where the <br /> condition or circumstance which prevented abatement within 90 days <br /> exists at the expiration of such extension. . .
