These proposals are based on the assessment conference held in our office January 3, 1991 . In attendance at that conference in addition to you and me were Lew Thompson representing Mid-Continent Resources, Inc. and Larry Routten and Mike Savage representing the Division. Mid-Continent Resources, Inc. requested that the conference stay open until they were able to further evaluate the violations and to allow them time to abate the NOV 's and to receive a good faith reduction. Access to most of the sites has been hampered because of recent snows and it will not be possible to get to the sites until next spring. Because of the inaccessibility Mid-Continent Resources Inc. has not abated the NOV's and is not eligible for good faith reductions. I do not believe it is appropriate to keep the conference open for a possible good faith reduction. However, abatement deadlines can be extended due to adverse weather. If you agree with the settlement agreements, please sign them and return them to our office as instructed on the form. If you disagree do not sign the forms. The Division will fix the civil penalty and you may appeal that decision to the Board as outlined in the regulations, Rule 5 .04.4. If you have any questions, please contact me, Sincerely, Sandra L.
