These proposals are based on the assessment conference <br /> held in our office January 3, 1991 . In attendance at that conference in <br /> addition to you and me were Lew Thompson representing Mid-Continent Resources, <br /> Inc. and Larry Routten and Mike Savage representing the Division. <br /> Mid-Continent Resources, Inc. requested that the conference stay open until <br /> they were able to further evaluate the violations and to allow them time to <br /> abate the NOV 's and to receive a good faith reduction. Access to most of the <br /> sites has been hampered because of recent snows and it will not be possible to <br /> get to the sites until next spring. Because of the inaccessibility <br /> Mid-Continent Resources Inc. has not abated the NOV's and is not eligible for <br /> good faith reductions. I do not believe it is appropriate to keep the <br /> conference open for a possible good faith reduction. However, abatement <br /> deadlines can be extended due to adverse weather. <br /> If you agree with the settlement agreements, please sign them and return <br /> them to our office as instructed on the form. If you disagree do not sign the <br /> forms. The Division will fix the civil penalty and you may appeal that <br /> decision to the Board as outlined in the regulations, Rule 5 .04.4. <br /> If you have any questions, please contact me, <br /> Sincerely, <br /> Sandra L.
