Directive INE-35 instructs Field Offices to not issue Ten-Day Notices in cases
where the State is committed to taking appropriate action within the specified
time frame. The AFO has been aware of our intent to issue NOV' s for the very
circumstances cited in TDN X-91-02-355-001 TV 2 since the initiation of the
joint inspection. Colorado has met its commitment. Therefore , we request
that this Ten-Day Notice be withdrawn .
