Renner, Coal Program Supervisor <br /> Mined Land Reclamation Division <br /> Department of Natural Resources <br /> 215 Centennial Building <br /> 1313 Sherman Street <br /> Denver, CO 80203 <br /> Re: Ten-Day Notice Noy 91-02-355-001, Coal Basin Mine, MidContinent <br /> Resources <br /> Dear Mr. Renner: <br /> The following is a written finding, in accordance with 30 CFR 842.11, <br /> regarding the Mined Land Reclamation Division's (MLRD) response to the <br /> above-referenced Ten-Day Notice (TDN) . <br /> On August 27, 1991, the Albuquerque Field Office (AFO) conducted a State <br /> enforcement follow-up inspection of the Coal Basin Mine. The inspection <br /> resulted in the issuance of the TDN referenced above for alleged <br /> violations of the Colorado rules. AFO received MLRD's response on <br /> September 13, 1991. <br /> The alleged violations were for: (1) Failure to minimize disturbance to <br /> the hydrologic balance from the mine roads by failing to maintain the <br /> roads to pervent erosion; and (2) failure to stabilize road cuts and <br /> fills. MLRD's response indicated that three Notices of Violation (NOV) <br /> (C-91-016, 017, and 018) were to be issued and would address the <br /> operator's failure to install, maintain and/or stabilize culverts, <br /> roads, ditches, outfalls, and road cuts and fills. The NOV's were <br /> issued on September 18, 1991. <br /> AFO has reviewed the NOV's and finds that they address the concerns <br /> outlined in the TDN. AFO, therefore, finds MLRD's response to TDN <br /> 91-02-355-001, Violations 1 and 2 of 2, to constitute appropriate <br /> action. AFO will continue to monitor the disposition of the State NOV's <br /> to ensure that the basis for AFO's finding is substantiated. <br />
