BANTA, Director <br /> DATE: December 13, 1989 <br /> TO: Mike Long <br /> FROM: Bill Crick`koc_ <br /> RE: Pattern of Violations, Coal Basin Mines (C-81-017) <br /> A review of enforcement actions during 1989 at the Coal Basin Mines, operated <br /> by Mid-Continent Resources, Inc. , indicates that a Pattern of Violations may <br /> exist. Five Violations and one Cessation Order have been issued between <br /> February and November of 1989. The CO and three NOV's are through <br /> administrative review and are final , while two additional NOV's are recent and <br /> have just begun the assessment process. <br /> NOV C-89-003 was issued on February 22, 1989 for failure to maintain <br /> facilities to treat water discharges from an underground mine and related <br /> performance standards. The pond series 016, which treats water pumped from <br /> the underground workings, froze due to extreme cold, resulting in <br /> short-circuiting of the ponds. Values of Total Suspended Solids of <br /> 6800 mg/l (1/26/89), 5400 mg/1 (2/2/89) , and 3100 mg/1 (2/23) were obtained, <br /> compared to the NPDES permit limits of 35 mg/1 monthly average and 70 mg/l <br /> maximum. The NOV was terminated on May 4 following installation of temporary <br /> sediment control , weekly monitoring of effluent from 016, and Division <br /> approval of a Technical Revision for enhanced sediment control . A Civil <br /> Penalty of $850.00 resulted from an assessment conference. <br /> NOV's C-89-013 and C-89-017 resulted from an inspection on May 24, 25, <br /> and 26, 1989. C-89-013 was for a violation of permit approval . A small-area <br /> exemption had been granted for an area under the raw coal conveyor belt, on <br /> the condition that no coal spillage take place. Coal spillage had occurred, <br /> however, and abatement consisted of cleaning of the spilled coal and <br /> installation of an approved sediment control system for the area. The <br /> violation was terminated on July 19, and an assessment conference led to a <br /> civil penalty of $1050.00. <br /> C-89-017 was written on the same date as C-89-013, for Failure to construct <br /> appropriate sediment control measures to prevent additional contributions of <br /> sediment to streamflow, and Failure to pass surface drainage from the <br /> disturbed area through a sediment pond or treatment facility. A <br /> newly-constructed topsoil stockpile had no sediment control installed. <br /> The violation was terminated on July 6, 1989, following installation of <br /> approved sediment control measures.
