Dear Mr. Mathews:
Mid-Continent has determined on the following plan for abatement of
NoV C-90-052 and will proceed diligently to complete the the
necessary work prior to July 18, 1991 . The areas specified in the
NoV are:
Southwest end of 3 Mine Pad. Outslope at Rock Tunnel Fill.
Upper/lower Sutey topsoil Outer slopes of topsoil
stockpiles. stockpile behind district
office.
Lumber storage area by Dutch South portal at No. 1 mine.
Creek at Road C crossing.
Topsoil stockpile at 016 pond. No. 1 Mine Substation.*
* This area was not included in the abatement list
contained in the violation, but was referenced in the
inspection report, and so is included in the abatement
plan.
Re. the South Portal at No. 1 Mine.
This area is a rock bench, .18 acre in size. This area was
developed for a ventilation opening. The bench itself slopes into
the hillside. Surrounding terrain is extremely steep,
characterized in places by sheer cliff faces.
The rock of the bench is a durable, non-erosive material, so heavy
sediment load is not a concern. Routing drainage to a sediment
pond from this location is not feasible, nor is construction of a
pond, given the topography. We had considered a catchment basin for
the low end of the bench, but the rock material does not allow
creation of the depression.
