JUSTIFICATION OF SETTLEMENT AGREEMENT FOR <br /> NOV C-90-052 <br /> NOV C-90-052 was written for "failure to pass all surface drainage from <br /> disturbed areas through sedimentation ponds or treatment facilities before <br /> leaving the permit area." Mr. Routten cited seven different areas. They are <br /> listed in the NOV. Slides were shown. <br /> Mid-Continent stated that one of the areas, the outer slope of the topsoil <br /> pile behind the district office, was incorrectly cited. It is not a topsoil <br /> pile but a berm constructed for flood control . Lumber has been removed from <br /> the pad next to the S. Dutch Creek crossing of Road C. Some maintenance is needed in a <br /> couple of the areas, but I consider it to be minimal .
