In this letter, AFO indicated that the TDN issues <br /> are now to be addressed as permit defects identified by a Ten Day letter, <br /> This letter serves as MLRD 's response to the Ten Day Letter. <br /> AFO indicated that there is a defect in the Coal Basin Mine permit which <br /> allowed a permitted pond discharge to occur which was not in compliance with <br /> MLRD Rule 4.05 .5(1 ). This rule requires that sediment control measures using <br /> the best technology currently available be used to: 1 ) prevent, to the extent <br /> possible, additional contributions of sediment to streamflow or to runoff <br /> outside the permit area, 2) meet applicable state or federal effluent <br /> limitations and, 3) minimize erosion. AFO requested documentation that MLRD <br /> is requiring a permit revision incorporating designs and specifications that <br /> address standards 1 and 3 above. <br /> The discharge in question was from the 016 pond series. As a result of past <br /> problems with the 016 ponds, MLRD and the operator investigated options for <br /> improving the treatment of mine discharge water, which currently passes <br /> through the 016 ponds. In October, 1990 the operator submitted a technical <br /> revision to MLRD proposing a new water treatment system. The operator has <br /> proposed a system of physical and chemical treatments underground and within <br /> the preparation plant, after which the treated water will be routed to the 001 <br /> ponds. The 016 ponds will then be used as a backup in case of problems with <br /> the water treatment system. <br /> This revision addresses the applicable criteria of Rule 4.05.5(1 ). The <br /> flocculant proposed will remove sediments from mine water prior to discharge <br /> to the surface. The operator has applied for an amendment to their NPDES <br /> permit and all discharges will continue to be required to meet specified <br /> effluent limitations. Diversion and pond designs will handle designed runoff <br /> flows in compliance with MLRD rules so as to minimize erosion. <br />
