Box 500 <br /> Carbondale, CO 81623 <br /> RE: Small Area exemption Demonstrations <br /> Dear Mr. Thompson: <br /> As you know, some permit defects were identified during our OSM oversight <br /> inspection of Coal Basin in October. These defects concern six small area <br /> exemptions in the permit which the Division approved in the past. In order to <br /> correct theopthattthesecarets ashqualifylas smallon rarea that <br /> exermptionstlinnt submit <br /> demonstratns <br /> accordance with Rule 4.U5.2(3 ). <br /> The six areas of concern are: <br /> 1 . SE corner of No. 4 Mine portal pad <br /> 2. No. 4 Mine coal pad <br /> 3. No. 4 Mine powder magazine <br /> 4. Rock tunnel powder magazine <br /> 5. No. 1 Mine powder magazine <br /> 6. No . 3 Mine coal storage bin . <br /> The demonstrations which Rule 4.05.2(3) requires for an exemption are: <br /> 1 . That drainage from the areas meets effluent limits and state water <br /> quality requirements (i .e. NPDES standards are not exceeded (point <br /> sources ) or receiving stream standards are not violated (non-point <br /> sources ) and, <br /> 2. That the area is small and that there is no mixture of surface <br /> drainage and mine water discharge. <br /> In order correct the permit defects in question, the Division requires that <br /> these demonstrations be submitted within 60 days of receipt of this letter. <br />
