RE: Small Area exemption Demonstrations
Dear Mr. Thompson:
As you know, some permit defects were identified during our OSM oversight
inspection of Coal Basin in October. These defects concern six small area
exemptions in the permit which the Division approved in the past. In order to

accordance with Rule 4.U5.2(3 ).
The six areas of concern are:
1 . SE corner of No. 4 Mine portal pad
2. No. 4 Mine coal pad
3. No. 4 Mine powder magazine
4. Rock tunnel powder magazine
5. No. 1 Mine powder magazine
6. No . 3 Mine coal storage bin .
The demonstrations which Rule 4.05.2(3) requires for an exemption are:
1 . That drainage from the areas meets effluent limits and state water
quality requirements (i .e. NPDES standards are not exceeded (point
sources ) or receiving stream standards are not violated (non-point
sources ) and,
2. That the area is small and that there is no mixture of surface
drainage and mine water discharge.
In order correct the permit defects in question, the Division requires that
these demonstrations be submitted within 60 days of receipt of this letter.
