AFO has reviewed MLRD's written and oral <br /> responses to this TDN and renders the following finding in accordance <br /> with 30 CFR 842.11(b) (1) (ii) (B) (1) : <br /> Violation 1 of 2 <br /> AFO has previously notified MLRD that its response as amended was <br /> appropriate. The operator was required to submit the demonstration <br /> documentation within the 30-day time period. <br /> Violation 2 of 2 <br /> AFO understands from the written and oral responses that: (1) A <br /> revision to the Coal Basin permit was approved on or about December 21, <br /> 1990. This revision addresses the mine water discharge that was a <br /> subject of the TDN; (2) this revision requires the operator to screen <br /> the mine water in the mine to filter the coarse materials from the <br /> water, use flocculent chemical treatment of the mine water at the Rock <br /> Tunnel mouth, and route the water through pond No. 020 prior to <br /> discharge into Coal Creek. In case of clean-out or an emergency, the <br /> discharge will be routed to the No. 001 pond prior to discharge into <br /> Coal Creek. The No. 016 pond will only receive the mine water in case <br /> the other sedimentation ponds referenced above become dysfunctional for <br />
