RE: Request for Consolidated Assessment Conference covering
NOV(s) C-89-033 , C-90-001 and C-90-002.
Dear Mr. Crick:
Mid-Continent has requested an assessment conference to review NOV
C-89-033 , issued December 21, 1989. Since then, two additional
Notices of Violation, NOV C-90-001 and C-90-002, have been issued,
both on January 4 , 1990.
Mid-Continent intends to request an assessment conference for both
C-90-001 and C-90-002. I'm writing to request of the Division that
the conference on C-89-033 be consolidated with the conference on
C-90-001 and C-90-002. This would be helpful to us as we will be
traveling to Denver for these conferences.
Section 5. 03.2(7) of the regulations provide for an informal
hearing within 30 days after issuance of a notice of violation.
Because our request for a consolidated hearing may conflict with
the 30 day requirement, Mid-Continent is willing to waive the
specified time frame, although not the right to the hearing.
Sec. 5.03.5 further allows that board review shall be within 90
days after the issuance of the notice. In the interests of a
consolidated proceeding, Mid-Continent is also willing to waive
the specified 90 day time frame, although not the right to board
review, for these notices of violation.
I hope this will be more convenient for the Division as well , and
will anticipate that we will decide in the near term on a date for
the informal hearing on these violations.
