At the time that the violations were issued, 1 considered your <br /> suggestion myself and rejected it for the following reason. The violation <br /> addressed in NOV C-90-014 concerns haul road drainage and failure to maintain <br /> a haul road drainage culvert, while the violation in NOV C-90-015 addresses <br /> failure to maintain a diversion structure. While I agree that both violations <br /> involve the failure of a CMA culvert, I felt it inappropriate, both during the <br /> inspection and now, to lump them into one Notice of Violation given the <br /> differing citations for each violation. <br /> While I would respectfully decline your request at this time, you might pursue <br /> it through the Director or through the Assessment Conference process. <br /> If 1 can assist you in this enforcement process please contact me. <br /> Sincerely: <br /> l" <br /> Michael S.
