(719) 275 -2047 <br />I spoke with Tony Adamic of Fremont County Department of Transportation regarding maintenance of <br />County Road 92 between the locked green gate, located at the north end of the GEC pit and the northern <br />boundary of the Southfield permitted access road. Recent rainstorms in the region have washed a <br />considerable sediment fan onto County road 92 south of the locked green gate. <br />I inquired of Mr. Adamic, who has responsibility for maintenance of Fremont County Road No. 92. Mr. <br />Adamic checked his records and found that Fremont County removed maintenance of Fremont County <br />Road No. 92 in 2008. The reasons for the county's termination of maintenance are twofold; 1) there are <br />no users on this road (other than Energy Fuels and the private landowners), and 2) the county is locked <br />out at the gate. <br />Fremont County has not required the gate to be removed or unlocked, but they no longer maintain <br />County Road 92. Fremont County retains "Right by Use" which means that the Country retains right of <br />way on the road. <br />Mr. Adamic confirmed that Energy Fuels erected the gate. Mr. Adamic was a former employee at the <br />Southfield Mine and remembers Energy Fuels installing the gate. <br />
