Chapter 5, Page 21 of the permit <br /> application states that "during the interim reclamation program, haul roads <br /> would be downgraded to access roads, the width narrowed, and slopes allowed to <br /> slough" . Page 17 discusses relocation of the road ditch out 10' from the <br /> hillside to "allow material to slough off the hillside and onto the inside of <br /> the road. " Page 22 includes the following statement: "The downhill slopes <br /> from the road will also be allowed to slough during the interim reclamation <br /> phase. They will not be seeded during the interim phase in order to encourage <br /> establishment of the most moderate possible slope" . I was not aware of the <br /> latter provision when I issued the NOV. <br /> I have not found evidence that the Division indicated specific concerns to <br /> Mid-Continent regarding interim stabilization of cuts and fills prior to a <br /> midterm review letter of April 24, 1991 . Interest in the matter was spurred <br /> in part by local citizen groups and the Forest Service, who had contacted us <br /> in regard to this issue and other matters regarding Coal Basin in 1990 and <br /> 1991 . These concerns led to the joint MLR-USFS inspection of July/August, <br /> 1991 . There are no specific comments , concerns, or recommendations regarding <br /> revegetation or other stabilization or sediment control measures for road cut <br /> or fill slopes in inspection reports between 1987 and July, 1991 . <br />
