Box 1298 <br /> Carbondale, CO 81602 <br /> Re: NOV C-91-018 Vacation Notice <br /> File No. C-81-017 <br /> Dear Ms. Delaney: <br /> As you are aware, based on information which was presented at the assess- <br /> ment conference for the above-referenced Notice of Vacation (NOV) , the <br /> conference officer recommended that the NOV be vacated . The Director <br /> concurred with the recommendation and has vacated the NOV. The Vacation <br /> Notice is enclosed. <br /> Despite the vacation of the violation, it is the Division' s determination <br /> that the permit conditions which allow for continued sloughing of cut- <br /> and-fill slopes are no longer appropriate, and the permit will need to be <br /> revised accordingly. Statements on pages 17, 21 and 22 of Chapter 5 of <br /> the approved permit which reference sloughage of cut-and-fill slopes as a <br /> component of the interim reclamation plan will need to be removed or <br /> appropriately modified. These changes should be submitted as a part of <br /> the previously submitted Permit Revision No. 2 application. <br /> In addition, the abatement measures specified in NOV C-91-018 for the <br /> identified cut-and-fill sections (or alternative measures which will in- <br /> sure compliance with Rules 4.03.2(3)(c)(ii ) , 4.03.2(3)(d)(x) and <br /> 4.03.3(1 )(a)) will need to be submitted for inclusion in the revision <br /> application. A schedule for implementation of specified treatments <br /> allowing for installation of stabilization/siltation control measures in <br /> lower elevation, more accessible areas first, with implementation in all <br /> areas to be completed no later than August 1 , 1992, shall be included. <br />
