I understand your concern regarding the <br /> Mid-Continent operation. We will continue to inspect and monitor the facility <br /> on a regular basis. <br /> At this time, we are requiring that Mid-Continent sample the water quality of <br /> Coal Creek twice per year. Once during periods of high flow and once during <br /> periods of low flow. In addition, they are required to sample discharges from <br /> their sediment control ponds at a minimum monthly, or more frequently if <br /> discharge is continuous. Discharge pond monitoring requirements are set out <br /> in the Department of Health's NPDES permits. Enclosed for your information is <br /> a copy of Mid-Continent' s monitoring program as required by the Division for <br /> surface and ground water. <br /> As a result of the violation, Mid-Continent has been required to modify their <br /> sediment pond cleaning schedule. Ponds are now to be cleaned whenever <br /> sediment levels in the pond exceed 60% of the designed sediment storage <br /> volume. The previous cleaning schedule required yearly or seasonal cleaning. <br /> In addition, we are requiring that Mid-Continent build additional sediment <br /> storage and treatment facilities over the course of the summer. We will <br /> continue to conduct inspections_ of the site at a minimum monthly or more <br /> frequently if necessary.
