Drawer 790 <br /> Glenwood Springs, Colorado 81601 <br /> Payment of Readjusted Rental and Royalty Required <br /> On September, 26, 1988, the Bureau of Land Management published a final <br /> rulemaking that revised the regulations under Title 43, Code of Federal <br /> Regulations (CFR), Subpart 3451, regarding the readjustment of federal coal <br /> leases. 53 FR 37296-37300. <br /> The revised regulations state that all readjusted terms and conditions shall <br /> be effective on the anniversary date, including the reporting and payment of <br /> rental and royalty. 43 CFR 3451.2(e), 53 FR 37300. The failure to pay the <br /> rentals and royalties at the readjusted rates within 30 days from receipt of <br /> this Notice and the enclosed Decision may subject the federal coal lease <br /> bond to collection and/or subject the coal lease to cancellation in a court <br /> of competent jurisdiction. <br /> In accordance with the Minerals Management Service regulations at 30 CFR <br /> 210.201 (1988), the lessee is required to file a Payor Information Form <br /> (Form MMS-4030) within 30 days of receipt of the enclosed Decision. The <br /> regulation at 30 CFR 210.202 also requires the submittal of Reports of Sales <br /> and Royalty Remittance—Solid Minerals (Form MMS 4014). The Minerals <br /> Management Service will assess interest on any late payment or underpayment, <br /> from the date that the rental or royalty payment was due to the date on <br /> which the payment was received. 30 CFR 218.202. Failure to comply with the <br /> reporting requirements of the Minerals Management Service will subject the <br /> lessee to the penalties provisions of the Minerals Management Service <br /> regulations.
