P.O. Drawer 790 Glenwood Springs, Colorado 81601 Notice of Readjusted Lease Terms and Conditions Coal lease C-030345 was issued effective April 1, 1961. Coal lease C-0125456 was created by partial assignment of lands from C-030345 and retains the original issue date of April 1, 1961. The leases were readjusted and became subject to the provisions of the Federal Coal Leasing Amendments Act of 1976 (FCLAA), as amended (90 Stat. 1083), effective June 1, 1981. Mid-Continent Coal & Coke Co. , 78 IBLA 178 (1984) and Mid-Continent Coal & Coke Co. , 76 IBLA 312 (1983), respectively. Federal coal leases C-030345 and C-0125456 are subject to their second readjustment of terms and conditions on April 1, 1991. Notice of intent to readjust coal leases C-030345 and C-0125456 was given to the lessee, Mid-Continent Resources, Inc. , March 31, 1989. As provided in the Mineral Leasing Act of 1920, as amended (41 Stat. 437, 30 U.S.C. 181 et seg.), the regulations, and Sec. 24 of the leases, we are hereby readjusting the terms and conditions of leases C-030345 and C-0125456. Copies of the readjusted leases are enclosed. The readjusted lease terms shall become effective April 1, 1991. The annual rental rate remains at $3.00 per acre or fraction thereof as provided in the current leases. The royalty rates, established by law and by regulations at Title 43, Code of Federal Regulations (CFR), Subpart 3473.3-2, continue to be 12'k percent of the value of the coal removed from a surface mine and 8 percent for coal removed from an underground mine. 55 Federal Register (FR) 2653, January 26, 1 The value of the coal shall be determined in accordance with the regulation at 30 CFR 206, as amended. 54 FR 1532, January 13, 1989.
