Director <br />Southfield Mine <br />Florence, CO 81226 <br />Re: Southfield Mine, C1981 -014, Third Quarter 2012 Sediment Pond Report <br />Dear Mr. Patterson: <br />On September 24, 2012 the Division received Third Quarter 2012 Sediment Pond Inspection reports for <br />the Southfield Mine. Four ponds, loadout pond 41, loadout pond 42, pond 44, and pond 45, are permitted <br />under the Southfield permit. The ponds were inspected on September 21, 2012. No problems or concerns <br />were reported with any of the four ponds during third quarter 2012 in Energy Fuels Coal, Inc.'s quarterly <br />reports. <br />The form submitted by EFCI indicates that additional discussion regarding pond 45 was written on the <br />back of the form. The copy of the report received by the Division was blank on the back of this sheet. <br />Please re -send the report for Pond 45 dated September 21, 2012 with the information noted on the back of <br />the page. The form submitted for the third quarter 2012 inspection of Load out Pond 41 has checked that <br />the "principal spillway system is in working order." As noted in the Division's inspection that occurred <br />on September 17, 2012, the gated valve on the primary spillway at Load out Pond 41 was missing, and <br />material from the slope north of the primary riser was sloughing into the riser. These discrepancies need <br />to be addressed, brought into compliance with the approved pond design, and reported on the quarterly <br />inspection report. <br />Nowhere on the quarterly inspection form for all four ponds, was "the depth and elevation of any <br />impounded waters" reported (Rule 4.05.9(15)(c). Please update the reports to address the Division's <br />concerns in order to meet the requirement of Rule 4.05.9(15).
