A "Reason to <br />Believe" letter was sent to the operator on September 25, 2012 indicating there was a possible <br />violation pursuant to Rule 3.1.12(1) for failure to maintain proper mine identification signage. <br />Staff's recommendation is that the Board find the operator in violation of Rule 3.1.12(1) and <br />assess a civil penalty of $100.00 per day of violation for 148 days, for a civil penalty amount of <br />$14,800.00, with all but $100.00 suspended if the operator complies with the corrective action. <br />The corrective action is to submit documentation by October 12, 2012 that a proper sign has <br />been posted at the mine entrance. <br />Operator(s) Signature: <br />By signing this, the Operator agrees to the stated violation and will comply with the Cease and <br />Desist Order, Corrective Action(s) and Civil Penalty outlined above on the Staff Summary Form <br />for Consent Agenda Items. <br />Operator Signature <br />Date Notary Public <br />My Commission Expires: <br />
