FEDERAL PERMITS AND LEASES <br /> The following are the permits (and the pertinent clauses protecting the <br /> integrity of National Forest lands) that Mid-Continent Resources, Inc. has with <br /> the Forest Service for use of National Forest lands in Coal Basin: <br /> 1. Special Use Permit issued 6/8/87 and amended on 12/19/89. <br /> This permit supersedes a special use permit designated: Mid-Continent <br /> Resources, Inc. , Class D Road Permit, 2/13/80. The permit covers a <br /> right of way 9.5 miles in length, 60 feet in width, and containing <br /> approximately 69 acres (Appendix E, Figure 2) . <br /> Pertinent clauses protecting the integrity of National Forest lands: <br /> Clause 2. The permittee in exercising the privileges granted by <br /> this permit shall comply with all applicable State and <br /> Federal laws, Executive Orders, and Federal rules and <br /> regulations. <br /> Clause 10. Permittee shall pay the Forest Service for its share of <br /> maintenance cost or perform maintenance, as determined <br /> by the Forest Service for all commercial use of the <br /> road. The maintenance of the Permittee shall be <br /> proportionate to total use and commensurate with its <br /> use. Any maintenance to be performed in accordance <br /> with an approved maintenance plan. In the event the <br /> road requires maintenance, restoration, or recon- <br /> struction work to accommodate the Permittee's needs the <br /> Forest Service shall authorize the work required in the <br /> same manner as provided herein for maintenance or in <br /> Clause 12 for reconstruction. The Permittee shall <br /> perform such work at its own expense. <br /> Clause 12. Any construction or reconstruction of the road shall be <br /> in accordance with the plans, specifications, and <br /> written stipulations approved by the Forest Service <br /> prior to beginning such construction or reconstruction. <br /> 2. Special Use Permit issued 6/9/87 and amended 1/25/88. This permit <br /> supersedes a special use permit designated: Mid continent Coal and <br /> Coke Co. , liquid waste/pipeline, 2/12/80. This permit covers 43.5 <br /> acres: sediment ponds (2.4 acres) ; 2500 feet paralleling 2" water and <br /> 4.5" methane gaslines on a 20 foot R.O.W. (1.1 acres) ; and 40 acres of <br /> coal refuse pile (Appendix E, Figure 3) . <br />
