This <br /> applies to drilling programs, opening coal test pits, taking soil or <br /> overburden samples, water or vegetative sampling that would disturb the land, <br /> etc. This does not apply to activities conducted within an approved coal <br /> mining permit area. The extraction of coal in any quantity must not be for <br /> commerical sale, otherwise a mining and reclamation permit would need to be <br /> obtained (Rule 4.21 .5 ) . <br /> How to Apply: Applicants planning activities for the extraction of less than <br /> or equal to 6 0 tons of coal must file a Notice of Intent to Conduct Coal <br /> Exploration ("Notice") . Applicants planning activities for the extraction of <br /> greater than 250 tons of coal are required to file an Application for a Permit <br /> ("Permit Application") to conduct coal exploration. <br /> Notice of Intent Contents: Notice requirements are listed in Rule 2.02.2(2) . <br /> There are eight informational requirements. The Division has Notice forms <br /> available. However, the operator has the option of using any format he <br /> desires. The degree of detail required depends on the type of project and <br /> amount of disturbance anticipated. <br /> Notice Review Procedures: The Division must review the Notice within 2 weeks <br /> of receipt. Three determinations are made by the Division: 1) whether the <br /> Notice is complete, 2) whether the project qualifies as coal exploration or <br /> coal mining, and 3) whether the project will "substantially disturb" the <br /> natural land surface.
