Crick <br /> Reclamation Specialist <br /> Mined Land Reclamation Division <br /> 215 Centennial Bldg. <br /> 1313 Sherman St. TAU�' 1 ' <br /> Denver, CO 80203-2273 <br /> RE: Approved Permit - Road Maintenance. <br /> Dear Mr. Crick: <br /> As a supplement to our conversation today concerning maintenance <br /> requirements for the roads, please note the attached which is <br /> contained in our approved permit under the sections covering road <br /> maintenance and interim reclamation. <br /> Our understanding of the approved permit is that we maintain the <br /> roads according to the current usage, and allow the roads to <br /> narrow. <br /> The reclamation section discusses the roads at some length, and <br /> our understanding is that it had been agreed between MLRD and Mid- <br /> Continent that the road width would narrow during the current <br /> interim reclamation phase (i.e. prior to final reclamation) through <br /> natural sloughage of the road, both above and below. <br /> The maintenance section says that the road surface- will be <br /> maintained "as necessary to maintain the road surface required for <br /> use and traffic volume. " <br /> Mid-Continent has applied for a technical revision to the permit <br /> which would designate the roads as light use roads, and thus allow <br /> for low water crossings. Our thinking in applying for the light use <br /> designation is that it would further clarify the issue of MLRD's <br /> expectation about road maintenance.
