Pitkin County <br /> November 29, 1990 <br /> Ms. Diane Delaney <br /> Government Affairs Director <br /> Mid-Continent Resources, Inc. <br /> 201 Centennial St. , Suite 406 <br /> Glenwood Springs, Colorado 81601 <br /> RE: Pitkin County Permit Hearing <br /> Dear Diane, <br /> This is to provide you with a written summary of the actions <br /> taken by the Pitkin County Commissioners at their Permit Hearing <br /> on the Mid-Continent Coal Basin Mines last Tuesday, November 27 . <br /> The purpose of the hearing was to review Mid-Continent's <br /> progress towards the design, permitting and installation of a new <br /> water treatment system to replace or supplement the 016 Pond <br /> System that has proven itself vulnerable to upset in the past. <br /> This effort began last year with Mid-Continent's committment to <br /> install a mechanical water treatment system. That attempt failed <br /> due to the allegedly illegal misuse of funds by your original <br /> contractor. Attempts to redesign and install an alternative <br /> system were delayed this summer by the underground fire and have <br /> recently been renewed. At your meeting with the County <br /> Commissioners of October 23 , you were required to present a <br /> fully-engineered plan for a new treatment system including a <br /> timetable for construction and plans. for state permitting. Last <br /> Tuesday's hearing was intended to review your compliance with <br /> those requirements. <br /> Following your discussion with the Board they made the <br /> following findings: <br /> 1. ) The plans presented are recognized as being partially <br /> responsive to our concerns insofar as they describe a new water <br /> treatment system which appears to be workable. You are <br /> proceeding to prepare for installation through the procurement of <br /> materials and the submission of these plans to the appropriate <br /> state agencies for their official review and approval . <br /> 2 . ) The Board determined to schedule a Show-Cause Hearing for <br /> their regular meeting on February 25. The purpose of that <br /> hearing will be to give Mid-Continent an opportunity to <br /> demonstrate why the Special Use Permit should not be revoked <br /> based on the failure to comply with the requirement for a new <br /> water treatment system.
