1. Water Treatment Plant: The operator's installation of the
mine-water treatment facility currently partially installed in
the coal preparation plant and operation of that plant as
designed, such installation and operation to be demonstrated
prior to the resumption of coal production. Should the MLRD
amend Mid-Continent's State Permit to duplicate this requirement,
the County will adopt that requirement in lieu of this one.
2 . Coal Waste Pile: The operator's agreement to notify the County
at least 120 days in advance of any removal of coal spoils from
Coal Basin for any purpose. Such an activity is not currently
permitted by the County and may lead to further amendment of
Permit #86-139 to address mitigation of impacts of that activity.
3 . Gas and Diesel Tanks: The operator's relocation of the
existing Gas and Diesel fuel tanks and/or pipelines to a location
whereby those pipelines are not suspended over any waterway or
drainage facility and whereby those tanks are adequately
safeguarded against leakage or other hazards. That relocation
will further be subject to the applicable standards of the Fire
Code, the State Oil and Gas Inspector and the State Water Quality
Control Division as their regulations relate to above-ground
tanks and spill containment.
4 . Coal Creek stabilization: The operator's agreement to
participate in discussions and to cooperate in coordinated
efforts to stabilize and improve the Coal Creek watershed through
revegetation, stabilization and watershed management programs.
Those programs are currently being pursued by the County. the
3
' J
