There was <br />additional sediment deposited both inside and outside of the green gates on County Rd. 92. The first attached <br />photo shows fresh tracks in this sediment. The ditch on the northwest side of this road has down cut another <br />foot or more. There is an area within the permit area on the northwest side of the road that is approximately 19( <br />ft. long which is a low spot that has collected standing water. The second attached photo shows this undrained <br />area of storm water. The road berm prevents drainage to the road ditch, and this area is lower than the drainage <br />ditches into sediment pond #5. <br />The water in sediment pond #5 reached a level 21 in. below the top of the vertical discharge pipe. The amount <br />of rain was sufficient to wash away much o the oil contaminated soil beneath the grader and the loader. <br />Here are my reasons for establishing Energy as being responsible for the County Road 92 and the resulting ditcl <br />erosion and sediment transporting off the premises. <br />1. Dorchester reconstructed this road when the mine was first opened. <br />2. Dorchester used the washplant reject for fill on the road. This is the material that is down cutting severely to <br />produce the gully on the northwest side of the road. <br />3. Energy has made several diagonal cuts across the road and maintained the road on a portion of the road far <br />outside its permit boundary sign. <br />4. Energy installed the green gates across the road in the 1990s, which gates have prevented Fremont County <br />
