Berhan Keffelew <br />Colorado Division of Reclamation Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Re: Permit Number d2004-031 — Hazeltine Mine, Revision No. TR-01 <br />Dear Mr. Keffelew: <br />As we discussed yesterday on the telephone, Aggregate Industries has been re- evaluating <br />the costs associated with the pumping system proposed by the above - referenced technical <br />revision for drainage and control of surface water elevation to reduce surface water levels <br />to pre- mining conditions. AI has determined that it may be more cost effective to <br />negotiate with neighboring property owner Fred Orr for purchase of his property and is <br />seeking approval for funding this option. Upon approval of such funding AI will contact <br />Mr. Orr to explore this avenue. <br />In order to proceed as proposed above AI requests an extension of the Division's decision <br />date for approval of TR -01 to October 16, 2012. At that time AI hopes to have initiated <br />conversation with Mr. Orr to negotiate the land purchase. If successful in reaching a <br />reasonable consensus for such purchase, it will likely take a longer period of time to <br />finalize terms of an agreement and AI would then request additional extension(s) as <br />necessary until closing on the purchase and then withdraw its request for TR -01. <br />We appreciate your consideration in this matter.
